By using AXIOM AI, you agree to these terms and conditions.

Introduction

The following terms and conditions constitute a contract between you and AXIOM AI ("this Agreement"). AXIOM AI is an application adhering to "Local-First" and "Privacy-First" principles, with core review algorithms running entirely on your local device. This Agreement governs your access to or use of the AXIOM AI application and related services ("the Services"). Even if you acquire the Services from the Apple App Store, this Agreement is solely between you and AXIOM AI. By using the Services, you represent that you have legal capacity and agree to be bound by this Agreement.

Accounts

Use of our Services requires an Apple ID. AXIOM AI employs a serverless architecture; all your learning data (including memory weights, vocabulary lists, review records) is encrypted and stored in your personal iCloud container. We cannot access, view, or sell any of your personal data. You are responsible for maintaining the security of your Apple ID; AXIOM AI is not responsible for any data loss resulting from compromised accounts.

You must be at least thirteen (13) years old (or the minimum age prescribed by Apple ID creation procedures in your country or region of residence) to create an account and use our Services. An Apple ID for a person below this age may be created by a parent or legal guardian using Family Sharing, or by an approved educational institution. When creating an account for a minor, the parent or legal guardian should read this Agreement carefully with the minor to ensure both parties understand it.

Scope of License

AXIOM AI grants you a non-transferable, non-exclusive license to use the Services on Apple-branded products that you own or control, solely for personal, non-commercial purposes.

Except as implicitly permitted by applicable law, you may not reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Services, nor use any automated tools (e.g., scripts, crawlers) to access the Services.

Rules for Use of Services and Content

Your use of the Services must comply with this Agreement and all applicable laws. You may use the Services and Content only for personal, non-commercial purposes, unless otherwise agreed.

You agree not to:

• Use the Services for any illegal, fraudulent, or malicious purpose.
• Attempt to crack, decompile, reverse engineer, or modify the App.
• Abuse, interfere with, or disrupt the normal operation of the Services.
• Infringe upon the intellectual property rights, privacy rights, or other rights of others.
• Use any automated means (e.g., bots, scrapers) to access the Services.
• Copy, distribute, or modify Service content for commercial purposes.
• Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices of AXIOM AI or third parties.

If you violate these provisions, we reserve the right to terminate your license to use the Services or restrict your access to online features (e.g., AI translation, speaking evaluation) without liability.

Certain features may require additional permissions, such as microphone access (for speaking practice). You can manage these permissions at any time in your device settings.

Intellectual Property

Proprietary information and materials contained in the Services (including but not limited to design, audio, code, interfaces, trademarks) are owned by AXIOM AI and protected by intellectual property laws. Without our prior written authorization, you may not copy, modify, distribute, sell, or exploit this content in any form.

AI Services & Data Disclaimer

Third-Party Generative AI

The translation and content generation features of the Services integrate third-party artificial intelligence technologies (which may include but are not limited to DeepSeek, Google Gemini, OpenAI, etc.). You understand and agree that when using these specific features, partially de-identified text data may be sent to third-party providers for processing.

Local Speaking Evaluation

The speaking evaluation feature of the Services runs entirely on your device's local Neural Engine. Your voice data is analyzed instantly on the current device only and is never sent to any third-party providers, nor uploaded to cloud servers or used to train models.

No Warranty Disclaimer

Given the nature of artificial intelligence technology, you understand and agree that any content generated by the Services (including but not limited to translation results, grammar analysis) may contain errors, inaccuracies, or fictitious information ("hallucinations"). This content is for reference only and should not be considered legal, medical, investment, or other professional advice.

Fair Use Policy

To ensure service availability for all users, abusive, high-frequency calls to AI interfaces (e.g., batch requests via scripts) are strictly prohibited. If we detect abnormal or abusive usage patterns, we reserve the right to restrict, suspend, or terminate your access to relevant AI features without additional notice.

Role of Apple & Third-Party Beneficiaries

Apple Not Responsible

You understand and agree that AXIOM AI (and not Apple) is solely responsible for the maintenance and support of the Services and its content, and Apple has no obligation to provide you with any maintenance or support related to the Services.

Third-Party Beneficiaries

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary regarding the portions relevant to it.

Disclaimer of Warranties; Limitation of Liability

To the maximum extent permitted by applicable law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied. AXIOM AI does not warrant that the Services will be uninterrupted, error-free, or free from malicious attacks.

In no event shall AXIOM AI's total liability to you (except as required by applicable law in cases involving personal injury) exceed the amount paid by you for the Services during the twelve (12) months prior to the event giving rise to the claim.

Governing Law

This Agreement is governed by the laws of your country or region, excluding its conflict of law rules.

If you reside in the United States, this Agreement is governed by the laws of the State of California.

Any dispute arising from this Agreement shall first be resolved through friendly negotiation; if negotiation fails, you may submit the dispute to a court of competent jurisdiction.

Other Provisions

This Agreement constitutes the entire agreement between you and AXIOM AI governing your use of the Services, superseding any prior agreements between you and AXIOM AI regarding the same subject matter.

If any part of this Agreement is held invalid or unenforceable, that part shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining provisions shall remain in full force and effect.

AXIOM AI's failure to enforce any right or provision in this Agreement will not constitute a waiver of such provision or any other provision.

AXIOM AI is not liable for failure to perform obligations due to causes beyond its control (e.g., force majeure, natural disasters, war, terrorist attacks, cyber attacks, etc.).

You agree to comply with all local, state/provincial, federal, and national laws, statutes, ordinances, and regulations applicable to your use of the Services.

No employee or agent of AXIOM AI has the authority to vary this Agreement.
